Thank you for using the Grace Gems site (the 'site'). Use this section for
information about the terms and conditions that govern your use of the site.
You will also find information on orders and returns, your privacy and your
security. If you have any questions, please contact us by clicking the link

1. Complete satisfaction promise
Grace Gems Limited guarantees your total satisfaction with our
products and services. If for any reason you are not satisfied with your online
purchase, simply call us within 14 days and return the goods to us.
2. Contract for sale
The advertising of products on this site is an 'invitation to treat'. That
means your order is an offer, not a contract of sale between you and Grace
Gems, so prices and stock availability won't be contractually confirmed until
you receive the 'confirmation of order' email dispatched once credit card
authorisation has been confirmed and stock levels have been checked. These
terms and conditions cannot be varied except by changes made by Grace Gems on
the site, which we may make from time to time. In particular, nothing said by
any representative of Grace Gems will operate as a variation to these terms and
conditions or constitutes a legal representation on behalf of them.
3. Receipt of order
Grace Gems must receive payment in full for your order before it can be
accepted. Once your credit card has been authorized and stock is checked, Grace
Gems will send you an email receipt confirming your order. Please keep this
receipt for your records. We can only accept orders for items that are in
stock. In exceptional circumstances, if we are not able to fulfill an order we
have accepted, your credit card will be re-credited with the original price and
we will notify you by email. In no circumstances will we be liable to you for
any additional amounts. Grace Gems reserve the right to refuse to supply to any
person for whatever reason.
4. Returning a product
If you need to return an item purchased online, contact us at
info@gracegemsltd.com or call us on 877-768-5484. You will need to have
your original credit card details handy for this call and we will need to talk
to the person who bought the item (so if you e-mail us then please leave a
phone number). Our customer care department will give you a return
authorisation number, which you need to include with the items being returned
along with the name of the person that placed the initial order, their
telephone number and the original order number. Please return (in the original
packaging if possible) to Grace Gems. A prompt refund will be issued if the
item is in its original condition and all the information referred to above is
received. The credit card used for the original purchase will be credited with
the original price. If there are any problems with your refund, a member of
Grace Gems staff will contact you.
Refund will be issued only after the products(s) received back are being
inspected by our staff and they have approved that the item(s) are in its
original condition. gracegemsltd.com reserves the right to refuse any refunds
of any amount if the item(s) is not found in its original condition. In case of
refunds, only the product(s) amount will be refunded to the buyer and not the
shipping and insurance amount which the buyer paid at the time of purchase.
5. Cancellations and exchanges
If you realised you made a mistake and want to cancel your order, please
contact us. Since we ship quickly, it may not be possible to stop your order so
please follow the instructions for 'Returning a Product' in those instances.
Exchanges work in the same way. It will be faster to re-order a product rather
than send it back for an exchange, so please follow the above instructions
while you order the product you would like instead. We realise this means two
transactions on your credit card but feel it is faster for you to get the
product you would like.
6. Defective and damaged items
If you should receive an item that is defective, damaged or not what you
ordered, please contact us within 10 days. A member of Grace Gems staff will
help you resolve any issues as quickly as possible by delivering another item,
replacing your order or refunding the amount paid.

information with any kind of site analysis, but we do look at the overall
browsing behavior of our customers to improve the way the site navigates. We
also do not track your behavior on any other sites or follow you once you've
left gracegemsltd.com, but we do use cookies to help us provide a personalized

Any personal data gathered by us in your use of this site will be recorded
electronically and only used in accordance with the US Data

delivery of your goods and provide our full customer service to you, as well as

Grace Gems work to keep the site up to date but cannot guarantee that this site
and its contents are completely free of technical errors. By using this site,
you acknowledge that you assume full responsibility for all costs associated
with all necessary servicing or repairs of any equipment you use in connection
with this site. We are also not liable for any damages associated with use of
this site however caused, incorrect prices or information.
All the gemstone(s) images shown on this site are approximate in size, color
and weight and they may vary from the original product(s) in all respects. If
you are not satisfied with the site, then please e-mail us with your comments.
However, your only recourse is to stop using the site.
13. Cool off period
Customers are legally entitled to cancel an order within 7 working days of
receipt of the product and to return it for a full refund. However, our
Complete Satisfaction Promise extends your ability to return an unsatisfactory
online purchase for up to 14 days.
14. Customer responsibility
Grace Gems cannot guarantee that the sale and delivery of its goods to your
particular country or location is permissible, so please be aware of your own
geographic import restrictions. This site and its contents will not constitute
the basis for any contractual commitment between Grace Gems and any prospective
customer in any jurisdiction in which the solicitation of interest or the
offering of or sale of products by Grace Gems would contravene any applicable
local, regional or national legislation. No prospective customer should seek to
make any order through the site from jurisdictions in which it would be illegal
for Grace Gems to sell products.
15. Gemstone Enhancement
Grace Gems Ltd. does not deal in any kind of lab created, man made, synthetic
stones or imitations. Though, most of the natural gemstones are being enhanced
in a manner commonly accepted by trade (GIA, AGTA & ICA). In general some
of the enhancement methods used are heating, treating, oiling, filling with
resign agents etc.
Some of the treatment methods used are coating, diffusion, dyeing, joban oil,
glass filling, irradiation, lasering etc. We do not know the methods used prior
to our purchase from the suppliers or our factories since each country uses
different methods. If required, we may send the gemstone(s) to a gem laboratory
for more information or issuing a certificate prior to your purchase, on your
request and expense.
In no matter or circumstances, Grace Gems Ltd. shall be held liable for any
such enhancements or treatments. In such conditions if the buyer is not
completely satisfied with the product(s), the only right reserved for the buyer
is to return the gemstone(s) back to Grace Gems Ltd. Within 14 days in its
original condition. Grace Gems Ltd. Will not accept any of its gemstone(s) back
if they are being tested by the buyer regardless of any gem laboratory, if not
found in its original condition
16. Legal Governance
Your use of this site and any contract between you and Grace Gems for the sale
of products shall be governed by and shall be construed in accordance with the
laws of USA and shall be subject to the exclusive jurisdiction of the
Courts of USA. If any provision of these terms and conditions shall be
unlawful, void or for any reason unenforceable, then that provision shall be
deemed severable for these terms and conditions and shall not affect the
validity or enforceability of any remaining provisions.
17. Copyright and other rights
All materials, including images, illustrations, designs layout, photographs,
written and other text or script that are part of this site are protected by
copyright, trade mark, trade dress and/or other intellectual property rights
owned, controlled or licensed to Grace Gems. The site as a whole is protected
by copyright and trade dress, all worldwide rights, titles and interests in and
to which are owned by Grace Gems. The contents of the site and the site as a
whole are intended solely for personal, non-commercial use. You may download or
copy the contents and other downloadable materials displayed on the site for
the sole purpose of placing an order with Grace Gems or using the site as a
shopping resource. No right, title or interest in any downloaded materials or
software is transferred to you as a result of any such downloading or copying.
You may not reproduce (except as noted above), publish, transmit, distribute,
display, modify, create derivative works from, sell or participate in any sale

18. LIMITATION OF DAMAGES

INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE), OR
FOR INTERRUPTED COMMUNICATIONS, LOST DATA, GOOD WILL, LOST PROFITS OR OTHER
INTANGIBLE LOSSES (EVEN AFTER BEING ADVISED OF THE POSSIBILITY OF THESE
DAMAGES), ARISING OUT OF OR IN CONNECTION WITH THIS USER AGREEMENT OR WITH THE
SERVICES PROVIDED HEREUNDER. gracegemsltd.com's LIABILITY, AND THE LIABILITY OF
gracegemsltd.com's SUPPLIERS, TO USER OR ANY THIRD PARTIES IS LIMITED TO THE
AMOUNT OF FEES USER PAID IN CONNECTION WITH THE TRANSACTION GIVING RISE TO
LIABILITY. Some states do not allow the limitation of liability, so the
foregoing limitations may not apply to you.
19. INDEMNIFICATION
Anything in this Agreement to the contrary notwithstanding, the User shall
indemnify and hold gracegemsltd.com harmless and defend gracegemsltd.com at
User's sole cost and expense against any loss or liability, claim, obligation,
action, cost or expense (including, without limitation, reasonable attorneys'
fees and disbursements of gracegemsltd.com's counsel), and all claims, actions,
procedures and suits arising out of or in connection with (i) the use of the
Service, (ii) the User's connection to the Service, (iv) a violation of the
terms and conditions of this User Agreement, and/or (v) the User's violation of
the rights of another person or entity.
20. PROPRIETARY RIGHTS
All content included on this site, such as text, graphics, logos, button icons,
images, audio clips, and software, is the property of gracegemsltd.com or its
content suppliers and is protected by U.S. and international copyright laws.
The compilation (meaning the collection, arrangement, and assembly) of all
content on this site is the exclusive property of gracegemsltd.com and is
protected by U.S. and international copyright laws. All software used on this
site is the property of gracegemsltd.com or its software suppliers and
protected by U.S. and international copyright laws. The content and software on
this site may be used as a purchasing or selling resource. Any other use,
including the reproduction, modification, distribution, transmission,
republication, display, or performance, of the content on this site is strictly
prohibited.
21. RELEASE
USER HEREBY AGREES THAT gracegemsltd.com SHALL NOT BE LIABLE AND HEREBY WAIVES,
RELEASES AND DISCHARGES gracegemsltd.com FOR ANY AND ALL CLAIMS, DEMANDS,
OBLIGATIONS, LIABILITY AND DAMAGES (ACTUAL OR CONSEQUENTIAL) OF EVERY KIND AND
NATURE, KNOWN AND UNKNOWN, SUSPECTED AND UNSUSPECTED, DISCLOSED AND
UNDISCLOSED, THE USER MAY HAVE REGARDING, ARISING OUT OF OR IN CONNECTION WITH
ANY DISPUTE ARISING OUT OF ANY TRANSACTION OR THE SERVICES PROVIDED HEREBY BY
gracegemsltd.com.
22. Shipping Policy
1. Grace Gems Ltd. Usually ships the goods within 2 business days after you
have received the confirmation of your order. However, in any condition
gracegemsltd.com shall not be held liable for any further delays in the
shipping of your order regardless of any circumstances.
2. The shipping method you chose at the time of
checkout cannot be changed or edited by you at any time after you have checked
out and the payment is made. If you want to change the shipping method or
procedure, you must cancel the order immediately and repurchase that particular
product again on our website. Since we ship fast so it may not be possible to
track or stop your package sometimes, in such condition the buyer will be
subject to the refund of only the product purchase amount and not the shipping
and insurance amount.
3. It is optional for the user to buy insurance, but
it is recommended that you buy the insurance of your product purchased as it
may be misplaced or lost by the shipping company. In such cases if the buyer
have bought the insurance, the shipping company will be liable to pay the
insured amount to Grace Gems Ltd. and thereafter the same amount will be issued
to the buyer. It is not known that how long it will take the claim to be
issued, since Grace Gems Ltd. Is entitled to issue you the claim amount only
after the receipt of payment by the shipping company. In no any such cases,
shall Grace Gems Ltd. be liable to replace the goods and pay the claim amount
to the buyer before the claim is received from the shipping company. Grace Gems
Ltd. will only pay the claim amount received from the shipping company and in
no circumstances shall Grace Gems Ltd. be liable to pay any excessive amounts
to the buyer. In any case if the shipping company denies to pay the claim then
all disputes will be subject to the exclusive jurisdiction of the courts of
United States of America. In case if the insurance is not purchased by the
buyer at the time of product purchase then Grace Gems Ltd. is not liable for
any claims or losses, refunds or replaces.
4. Once the package or parcel has left the
possession of Grace Gems Ltd., we are not responsible for any losses, damages
or claims arising due to the irresponsive handling of the shipping company or
the buyer itself, in any circumstances.
5. Grace Gems Ltd. does not ship any goods or
products to hotel rooms, trade shows, conferences etc. In any case if the
shipping address provided by the user is not correct then we shall not be
liable for any consequences arising due to whatever reason.
6. Grace Gems Ltd. shall not be liable for any
delays caused by the shipping company.
